All the files currently generated by oi-build (e.g., gmake sample-manifest) contain the old OpenSolaris CDDL header along with a "Copyright 2011 Oracle" line.  It should be the Illumos CDDL header with a sane copyright default. (Illumos? OpenIndiana?)
