I cannot confirm what you are claiming (I've
never ever seen or heard of such a behaviour):

# uname -a
SunOS opensolaris 5.11 oi_151a9 i86pc i386 i86pc

# mkfile 100m /tmp/tt

# zpool create test /tmp/tt

# zpool status test

   pool: test
  state: ONLINE
   scan: none requested
config:

	NAME STATE READ WRITE CKSUM
	test ONLINE 0 0 0
	  /tmp/tt ONLINE 0 0 0

errors: No known data errors

# zfs get casesensitivity test
NAME PROPERTY VALUE SOURCE
test casesensitivity sensitive -

# zfs create test/testzfs

# zfs get casesensitivity test/testzfs
NAME PROPERTY VALUE SOURCE
test/testzfs casesensitivity sensitive -

# mkdir /test/testzfs/a
# mkdir /test/testzfs/A

# ls /test/testzfs/
a/ A/
