This topic has all been discussed before and the discussions are 
available via the mail archives.

The BSD license is compatible with CDDL.  Illumos contains BSD code 
and FreeBSD contains CDDL code.

The skills to implement USB3 support do exist in the community but the 
developers are currently focused on other things.
